軍購條例終於過了！立院三讀7800億 明定採購武器項目
Newtalk新聞 立法院會今（8日）三讀朝野爭議已久的國防特別條例，藍白兩黨以席次優勢，經全案付表決後，以59票贊成、0票反對、48票棄權，表決通過兩黨共同提出的7800億元版本，包含已公開的110億美元部份（約3000億台幣）及預期一年內美方將同意出售的第二批的4800億元台幣部分，條文並明訂具體的武器採購項目。 今天下午在立法院會通過的「保衛國家安全及強化不對稱戰力計畫採購特別條例」，主要分為兩個部分，在條例第5條明列，採購項目包括：第一批，美方110億元發價書已公開的M109A7自走砲、海馬士多管火箭系統、反甲型無人機飛彈系統、標槍反甲飛彈、拖式2B反甲飛彈；第二批，國防特別條例施行後，美方預期在一年內同意出售的追加軍購項目，包括：軟硬殺混合反制無人機系統、各型反彈道及防空飛彈、中低空防空飛彈、反甲飛彈戰備存量補充案。 條例第6條也明定，第一批已有發價書的第5條第一項第一款至第五款項目之預算上限為3000億元；而第5條第一項第六款項目應取得外國政府正式同意售予後，依據第二批發價書實編列預算案，其預算上限為4800億元；預算之編列以特別預算方式編列，其預算編製不受預算法第23條及第84條之規定限制，非經立法院同意，不得項目流用。 同時規定，採購採一年一期方式編列，期滿後續預算及期程經立法院同意後，分期辦理預算籌編及審議，行政院應於本條例通過後一個月內，就第一批發價書預算案向立法院提出下列專案報告並備質詢，經立法院同意後始得籌編預算案；第二批發價書預算案亦同。 此外，行政院應於條例通過後一個月內，針對過去5年軍事採購之項目、金額、效益與到貨情形，以及採購項目如何提升聯戰效能等向立法院提出專案報告，經立法院同意後始得籌編預算案：立院同意後，行政院應於兩個月內將第一批特別預算送交立院審議。 附帶決議中，為確保對美軍購交貨時程能符合我國建軍戰備需要，避免軍購延宕影響國家整體防衛量能，或因延遲交貨，導致武器裝備過時不符需求。依本條例之採購應與美方討論個案執行狀況，並向立法院報告。 國防特別條例的施行期間，自公布日施行至民國122年12月31日止，條例施行期滿，未及執行部分，必要時得經立法院同意延長。延伸閱讀：｢三班護病比｣納標準！護理團體聯合聲明：堅決反對醫院以缺工卸責快訊》《醫療法》三讀修正！三班護病比正式入法 罰則最重停業1年 藍白軍購案7800億 韓國瑜、盧秀燕、黃國昌、鄭麗文四方有共識 軍購案今決戰國會 卓榮泰喊話國民黨中央「放手」 「朱系」也滿意軍購7800億＋600億 凌濤感謝國民黨中央、藍白黨團
