高虹安涉誣告陳時奮案 二審7/31宣判
遭停職的新竹市長高虹安（右）被旅美教授陳時奮自訴誣告罪，台灣高等法院6月26日開庭。中央社記者謝幸恩攝 114年6月26日 Newtalk新聞 （中央社記者謝幸恩台北3日電）遭停職的新竹市長高虹安被旅美教授陳時奮自訴誣告罪，一審判刑10月，經上訴，二審高院今天開庭，陳時奮請求重判高虹安，高虹安則請求無罪判決，法官諭知本案於7月31日宣判。 全案緣於，高虹安不滿陳時奮於民國110年在臉書（Facebook）發文指出「被指導教授除名的高虹安」等言論，提告加重誹謗罪；陳時奮獲台北地檢署不起訴處分後，自訴高虹安誣告。 一審台北地方法院判決指出，高虹安明知博士論文有抄襲期刊論文情事，陳時奮發文指控內容與事實並無相悖，竟對陳時奮提告，具誣告的直接故意，依誣告罪判處有期徒刑10月。 案經兩造上訴，二審由台灣高等法院審理，二審今天再度開庭，雙方針對量刑部分進行言詞辯論。 高虹安引用前新竹市長林智堅論文爭議為例，認為陳時奮與台灣大學、中華大學站在對立面，主張已被撤銷2個學位的林智堅是冤案，而就本案而言，陳時奮同樣與校方站在對立面，並堅稱未被撤銷學位的她涉抄襲論文。 高虹安進一步表示，依照一般社會大眾觀念，抄襲與否通常以校方學倫審查結果作為判斷，而抄襲是評價、意見表達，陳時奮在推論她的論文是否抄襲的過程涉及誇大、不實言論，此部分是她提告的範圍，請求還她無罪判決。 陳時奮則說，高虹安的論文涉抄襲、反覆、灌水等爭議，其說法與北檢、北院的結果處於平行時空，為了選舉利益而扭曲事實、不實陳述，浪費司法資源，濫用司法作秀，並多次攻擊法院審理不公，反過來攻擊他說謊。 陳時奮也表示，抄襲在歐美政治人物是死罪，高虹安沒有司法誠信，敗訴後至今沒有道歉，犯後態度惡劣，毫無悔意，請求法院重判。 法官庭末諭知，本案今天言詞辯論終結，將於7月31日上午9時30分宣判。高虹安離開法院前，被媒體問及對於前台北市副市長彭振聲妻子墜樓身亡一事，她並無回應，隨即上車離去。（編輯：龍柏安）1140703 延伸閱讀：全台宣講反罷免 藍青年軍宣布成立「護民主戰隊」從優勢爭霸到聚焦拒止？中國稱美國海軍戰略「轉向」熱帶擾動接近水氣增！氣象署：是否發展為颱風「今明兩天」是關鍵美跳傘專機衝出新澤西機場跑道! 至少15人受傷 FAA調查事故原因
