抗議高雄診所惡老闆壓榨!工會聲援護理師捍衛應有尊嚴與權益
Newtalk新聞 「抗議惡老闆!壓榨護理師!」今(16)日上午,台灣護理產業工會與台灣醫療工會聯合會、高醫工會等聲援團體,於高雄「僾彼高榮育仁診所」前召開記者會,抗議該診所以違法「負時數、工時水庫」制度挪移護理師的工時、苛扣加班費、超時排班、勞保高薪低報、不合理高額違約金等,一共違反勞動法令高達近20條。 而當護理師不忍剝削、決定離開,卻反遭診所苛扣未領之薪資、甚至提告求償,變相懲罰離職護理師。如此「惡老闆、先告狀」的行徑,激起護理師與工會憤怒,除抗議要求診所撤告、還錢,並要求高雄市衛生局長黃志中下台、衛福部長邱泰源不要再裝傻。 台灣護理產業工會理事長羅運生表示,多名護理師向工會申訴,頻頻超時工作,加班費卻被診所用俗稱「工時水庫」的負時數制度給吞噬。正常狀況下,勞工每個工作日若「延長工時」都應領取時薪1.34或1.67倍的加班費。然而,僾彼診所規定,員工每月工時172小時(工時水庫),逾172小時才能算加班。即便單日工時逾八小時、一週工作逾五日,均不會發給加班費。 與此同時,診所採「批班」制度,依診所每日病患來診量浮動,將護理人力作「最有效率」的運用,當病人數不如預期時,主管會臨時告知員工晚點來或提早回家並扣減其工時。主管片面變更勞工上班時間,卻要求勞工吸收減少的時數。護理師若累積「負一天」,就等於護理師欠診所一天薪水。 羅運生痛批,10年前勞動部和衛福部就宣告「負時數」與「批班」違法,但許多診所卻積習難改、政府也未介入改善,工會仍時常收到相關申訴。「負時數」導致護理師被偷走鉅額加班費,「批班」則導致護理師無法安心生活。病人數浮動乃雇主營運之必然,非勞工因素所致,勞工的休假卻因此變得零碎、臨時,無法事前得知、無法安排生活,嚴重損害護理人員休息權與收入,呼籲社會各界正視基層護理人員處境,要求政府介入調查並糾正診所違法,捍衛勞工應有的尊嚴與權益。 診所第二大違法爭議,則是以鉅額「違約金」恐嚇離職員工。僾彼診所要求新進護理師簽訂「培訓承諾切結書」,宣稱診所將提供三個月教育訓練,支付護理師「培訓費用」三萬元/月,護理師若任職未滿三年,則需償還培訓費用。 但實際上,僾彼診所只提供環境介紹等一般性的新進人員訓練,護理師還要自費、自假去台灣腎臟醫學會接受護士血液透析訓練。護理師一到職就開始從事病患照護等工作,而合約上寫的「培訓費用」指的就是月薪。羅運生痛斥,診所沒有提供專業訓練、沒有額外給予留任獎金,竟還要求護理師賠償「前三個月薪水」才能離職,「根本是用假培訓、真罰款的手法綁住勞工」。 僾彼診所將護理師的薪資拆成兩部分,底薪與專業證照加給等計入投保薪資,轉進薪資帳戶,專業積點、治療積點、夜班費等則是發「現金」,不計入勞保。羅運生指出,這是許多醫療院所慣用的手段,壓低繳給政府的勞健保雇主負擔,也節省給勞工的退休金提撥金額。羅運生質疑,醫療院所在和健保要錢時,總喊說健保錢不夠,但當醫療院所作為健保付費者時,卻又偷斤半兩甚至破壞勞工退休安定,令人髮指。 羅運生強調,除以上問題外,僾彼診所沒有依勞工意願安排特休、短發特休未休工資、國定假日未發給加班費,亦未與勞工協商挪移;工時爆表一日逾12小時;未安排員工工作4小時後,休息30分鐘。當員工察覺有異、向診所索取打卡紀錄時,也遭雇主拒絕,甚至在護理師離職證明書上註記「違約」。診所違法苛待勞工問題重重,讓人難過的是,全台仍有許多護理師,長期來都在這樣惡劣的勞動環境中辛勤工作。護理人力流失,還令人訝異嗎? 任職僾彼診所近兩年的被告王姓護理師,今天也現身說法,並滿腹委屈、心寒表示,「我認真上班,卻要賠錢給老闆,難道我是免費勞工嗎?」她今年二月離職後,因不願繳交違約金,反遭診所提告求償8萬5千元「損害賠償」,另以「負時數」為由要求她「返還不當得利」9千元薪資。她感到極度委屈,「我有執照,正常上下班,為什麼離職還要賠錢給老闆?」 王姓護理師沉重揭露診所有諸多內規處處違法,人力不足時,要求護理師超時加班、病人數少時要求護理師提早回家、加班費未給、班表過勞、勞健保不實,還曾要求員工私下付錢給會計。她與主管溝通無效, 無法忍受故決定離職。不料,提離職後還被頻繁約談、威脅未來難找工作,王護理師嘗試據理力爭卻遭威脅「我們沒有要跟你走勞基法,直接走民事訴訟」、「你這樣以後找工作會有影響」。王護理師身心俱疲表示「我真的非常心寒與害怕」。 工會最後演出行動劇,諷刺僾彼診所非法壓榨制度並頒發「惡老闆認證」給該診所。工會呼籲,政府應立即查處僾彼診所違法行為,診所應撤回對護理師的不當訴訟、返還加班費與薪資,並誠實面對錯誤,改善用人制度,莫再壓榨與恐嚇基層護理人員。延伸閱讀:強力監督高雄三元能源火災 賴瑞隆:兩週內提出完整檢討報告「護身軍刀」秀火力 美澳日韓法星首日遠程武器精準打擊開轟「蘿莉島」案越演越烈! 備忘錄惹怒MAGA派 川普政府內部裂痕浮現 范斯急當調人賴清德團結國家十講耽誤大罷免?民進黨:優先處理災情、關稅(影) 烏克蘭迎千禧女總理 澤連斯基換總理、撤大使、備戰川普路線突變(影) 俄軍可笑「隱形衣」! 穿了反而更容易被發現 紅外線偵測下烏軍一覽無遺
邊荷律涼水祭遭「不明液體射眼睛」!網氣炸:到底在幹嘛
