竹市街頭警連開10多槍 嫌犯拒捕衝撞逃逸

台北地檢署偵辦前民進黨黨工涉共諜案，黃取榮（前）、外交部長辦公室前諮議何仁傑等涉洩漏國家機密給中國情工人員，情節重大，各判刑10年及8年2月。（中央社檔案照片） Newtalk新聞 （中央社記者劉世怡台北25日電）前民進黨黨工涉共諜案，台北地院今認定新北市議員李余典前特助黃取榮、外交部長辦公室前諮議何仁傑涉洩漏國家機密給中國情工人員，情節重大，各判刑10年及8年2月，可上訴。 本案被告黃取榮、何仁傑、吳尚雨、邱世元，因涉共諜案，已被民進黨地方黨部除名。 根據台北地院公布的新聞資料指出，時任外交部長辦公室諮議即被告何仁傑，於民國112年間利用確認外交部長行程、外交部業務人員向外交部長報告或私下查看資料機會，將其所獲取公務上秘密2份及機密1份接續交予黃取榮，黃取榮並混和公開資料和秘密及機密資料撰寫成分析報告，以加密軟體傳送予中國情工人員。 另一方面，黃取榮指示邱世元接續向時任副總統辦公室諮議即被告吳尚雨，刺探及收集總統出訪行程細節的1份資料（原為機密，待行程結束後已解密）及副總統國內選舉行程4份資料（公務上秘密，待行程結束後已解密）；吳尚雨基於與邱世元的交情，將這些資料傳送交付給邱世元。 台北地院合議庭認定，在報酬及洗錢部分：黃取榮獲得中國情工人員交付的工作所得共新台幣497萬7500元、邱世元獲得的工作所得共221萬6924元，兩人利用頻繁往返兩岸的台商接續將這些工作所得，輾轉匯回台灣而領出。 北院指出，黃取榮及何仁傑雖否認犯行，但有相關證人證詞，包含法院依職權選任的專家證人到庭證述，核與卷內物證、書證等證據資料相符，邱世元及吳尚雨於偵審中均坦承不諱，再加上相關證人證詞，確認4人犯行明確。 此外，檢察官起訴指部分公務上應秘密資料，合議庭考量因可在網路上公開資料查得而非秘密；部分機密因不符合國家機密保護法的構成要件而非屬機密，此部分不另為無罪諭知。 北院合議庭審酌4人，均長期從事黨職或公職，理應知悉效忠國家的重要性，他們所刺探、收集、洩漏及交付的資料，涉及國家外交資訊與首長行程等外交重要情報等相關內容，致現在艱難的外交處境雪上加霜，助長中國法律戰、輿論戰、心理戰「三戰」的作為，期間甚長，且所交付的資料涉及外交部會等高層行程，危害國家外交安全，殊值非難。 合議庭考量邱世元及吳尚雨均坦承全部犯行，黃取榮及何仁傑均自始否認的犯後態度，邱世元已繳交全部犯罪所得等，分別量刑。 台北地院認定黃取榮行為構成3罪，分別為共同犯國家機密保護法洩漏及交付經核定之國家機密於大陸地區罪、同法為大陸地區刺探及收集經核定之國家機密罪，共同犯洗錢防制法洗錢罪，判應執行有期徒刑10年，併科罰金新台幣100萬元，罰金得易服勞役，未扣案的犯罪所得497萬7500元沒收。 何仁傑共同犯國家機密保護法洩漏及交付經核定之國家機密於大陸地區罪，判刑8年2月；吳尚雨犯國家機密保護法洩漏及交付經核定之國家機密罪，判刑4年。 邱世元行為構成2罪，共同犯國家機密保護法為大陸地區刺探及收集經核定之國家機密罪、共同犯洗錢防制法洗錢罪，應執行6年2月，併科罰金5萬元，罰金得易服勞役，扣案犯罪所得221萬6924元沒收。全案可上訴。（編輯：方沛清）1140925 延伸閱讀：花蓮光復滿目瘡痍！居民急PO文求助 「家園慘變垃圾場」畫面曝光綠營黨團Line群組外流、王定宇怒退群 鍾佳濱：抓內鬼大可不必華爾街日報：澤連斯基笑臉攻勢奏效 美官員簡報也改變川普想法傅崐萁不顧馬太鞍救災只想甩鍋打口水戰 她傻眼：是對死者最大的羞辱景氣警訊響徹全球！美製造業陷連六個月衰退 就業市場急凍堰塞湖溢流釀14死 許美華：這場「人禍」真是政治照妖鏡 怒轟3人沒良知！

花蓮光復掩埋場也被沖掉！彭啟明估清淤量破萬噸：2週內清除完畢
